Zabbix Personal data processing policy for recruitment

1. Controller

SIA ZABBIX, registration No.40003738045, legal address Riga, Dzelzavas iela 117, telephone +371 6778 4700 e-mail [email protected] (hereinafter referred to also as We or the Controller), in accordance with provisions of Article 13 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (hereinafter referred to as - the Regulation) , informs you about personal data processing during the recruitment process.

2. Personal data that we process

When receiving your application for a vacant position, we process all information that you will have included in your CV and application letter (such as name, surname, contact information, work and study/training experience, language proficiency, additional knowledge/skills) or have attached as annex to your CV;

In case if you will be invited for a job interview - information provided, tests completed or other examination works performed during the job interview;

Information related to organization of the recruitment process (such as information on the fact that we have or have not contacted with you, notices about the time and course of the potential meeting); Information from persons, who have provided feedbacks about you (only in the case if you have clearly permitted to contact with the relevant persons in order to receive feedbacks).

3. Aim or purpose of data processing

Personnel data shall be processed for the purpose of recruitment and provision of legal interests, as long as they are related to recruitment: when receiving your application, the Controller shall evaluate the information provided therein, organize and perform interviews, as well as other organizational measures related to recruitment process. Within the framework of the recruitment process the Controller will also provide evidences, confirming legal course of the relevant recruitment process, and data may be used in the case of dispute.

There are no automated decisions made or profiling performed on the basis of your personal data, acquired during the recruitment process.

4. Judicial (legal) basis of data processing

Upon receipt of your application, the legal interest arises for the Controller to process the application and to evaluate the information provided therein, as well as to organize recruitment process and to provide itself with evidences about the legal course of the relevant proceeding. Article 6(1)(f) of the Regulation serves as a judicial (legal) basis of such data processing.

If you have unequivocally permitted to contact with certain persons in order to receive feedbacks, Article 6(1)(a) of the Regulation (your consent) shall serve as a judicial (legal) basis for such data processing.

You have the right at any time to withdraw your consent, however, starting as of the moment, when have contacted with the relevant person and have received the feedback, we process the received feedbacks, on the basis of Article 6(a)(f) of the Regulation.

If you have showed your wish to apply for future positions (for example, in the case when any other candidate is selected for the position, but the Controller offers to store the information about you for other vacant positions, or in the case when you have sent your CV to the Controller not for any particular position, but for the potential future position and the Controller considers your application as valuable), the Controller shall process your personal data on the basis of your consent. You shall have the right at any time to withdraw your consent. Judicial (legal) basis of such data processing shall be Article 6(1)(a) of the Regulation (until the moment, when you decide to apply for any particular position) and you shall have the right to withdraw your consent at any time. When you apply again for a particular position, the above-mentioned judicial (legal) basis - Article 6(1)(f) of the Regulation - is being applied.

5. Who will receive your personal data

Processing of your personal data will be performed by authorized employees of the Controller, in accordance with the scope determined in their work duties, taking into account the requirements determined by personal data protection and other regulatory enactments, as well as personal data processing requirements determined by Our internal regulatory enactments;

In case when a complaint is received regarding the relevant recruitment process, data may be determined to law enforcement or supervisory authorities (for example, the State Labour Inspectorate), court, as well as processors of the Controller - providers of legal services. It is not planned to deliver personal data abroad of the European Union and European Economic Area countries.

6. For how long do we store your personal data

Information, which is acquired, when the applicant applies for the vacant position and within the framework of the recruitment process, shall be stored in full or in part for not longer than thirty months from the moment, when the relevant recruitment process has closed.

If a complaint is received regarding the relevant recruitment process, the whole information acquired during the recruitment process (also about you, even if you have not submitted the complaint) may be stored until examination of the complaint and complete settlement thereof (for example, the day of the relevant court judgment coming into force).

The expected storage period of personal data in the case, if you have agreed to apply for the future vacant positions - two years from the day of receipt of the relevant consent, or until the day, when you withdraw your consent (i.e.do not want to apply any more for the future positions and you have accordingly informed us about that).

You shall have the right to request limitation of data processing or object against processing of your data, as well as the right to data portability and data modification.

You shall have the right to request erasure of data. However, your request to erase data may be rejected, if in the relevant situation the Controller has powerful legal reasons for processing, being more important than your rights to erasure of data.

Besides, you have the right to turn to supervisory authority (State Data Inspectorate, Blaumaņa iela 11/13-15, Riga, LV-1011) with a complaint regarding the action of the Controller, if you consider that it violates your rights as a data subject.

8. General Conditions

The Controller may make changes to the present policy. The Controller shall inform about changes by placing the relevant information on its website. If the relevant changes will affect processing of your personal data in the direct way, the Controller may send the relevant information to your e-mail address or mobile phone connection number, if there will be your contact information in Our data base.
